These Terms and Conditions ("Terms") govern your access to and use of the Den mobile application, website, and related services (collectively, the "Service") provided by MD Teknoloji Bilişim ve Ticaret Anonim Şirketi ("Den," "we," "us," or "our").

By downloading, accessing, or using Den, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. About Den

Den is a language-learning application designed to help users learn English and German through stories, songs, listening exercises, flashcards, progress tracking, and AI-powered language analysis.

2. Eligibility

You may use the Service only if you are legally capable of entering into a binding agreement under applicable law.

If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.

3. Account Registration

Some features of the Service may require you to create an account.

You agree to:

  • provide accurate, current, and complete information;
  • keep your login credentials secure;
  • be responsible for all activities under your account; and
  • notify us promptly if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.

4. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.

You may not:

  • copy, reproduce, distribute, or publicly display the Service except as expressly allowed;
  • modify, adapt, reverse engineer, decompile, or attempt to extract source code, except where prohibited by law;
  • use the Service for unlawful, abusive, or fraudulent purposes;
  • interfere with the operation or security of the Service;
  • scrape, crawl, or automatically extract data from the Service without permission.

5. Educational Purpose

Den is provided for educational and informational purposes only. We do not guarantee fluency, exam results, employment outcomes, or any specific learning result from using the Service.

Your progress depends on many factors, including your study habits, consistency, and prior knowledge.

6. AI-Powered Features

Den may include AI-powered tools that provide explanations, translations, contextual analysis, recommendations, and similar outputs.

You acknowledge and agree that:

  • AI-generated content may sometimes be incomplete, inaccurate, or inappropriate;
  • AI outputs are provided for general educational assistance only;
  • you are responsible for reviewing and evaluating any AI-generated content before relying on it.

We may improve our AI features over time, and features may change, be limited, or be discontinued without notice.

7. User Content

You may be able to submit words, phrases, sentences, responses, feedback, or other content through the Service ("User Content").

You retain ownership of your User Content. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, and use that content only as necessary to:

  • operate the Service;
  • provide requested features;
  • improve performance, safety, and functionality; and
  • comply with legal obligations.

You represent and warrant that:

  • you own or have the necessary rights to submit the User Content;
  • your User Content does not violate any law or third-party rights;
  • your User Content does not contain unlawful, abusive, harmful, or infringing material.

8. Prohibited Conduct

You agree not to:

  • use the Service in violation of any law or regulation;
  • upload or submit content that is defamatory, threatening, hateful, obscene, or infringing;
  • attempt to gain unauthorized access to accounts, systems, or networks;
  • use bots, scripts, or automated methods to access the Service;
  • exploit the Service for spam, phishing, or malicious activity;
  • misuse song, story, or other content made available through the Service.

We may investigate violations and take appropriate action, including suspension or termination of access.

9. Subscriptions and Paid Features

Some parts of the Service may be available only through a paid subscription or one-time purchase.

If you purchase a subscription through Apple:

  • payment will be charged through your Apple account;
  • subscriptions may renew automatically unless cancelled before the renewal date;
  • billing, renewal, and cancellation are managed by Apple under your Apple account settings.

We may change pricing, available plans, features, or subscription offerings at any time to the extent permitted by applicable law.

Unless required by applicable law, all purchases are final and non-refundable once processed. Refund requests for purchases made through Apple are handled solely by Apple in accordance with Apple's policies. Cancelling a subscription stops future renewals only and does not entitle the user to a refund for the current billing period, unless otherwise required by law.

10. Free Trials and Promotional Offers

We may offer free trials, discounts, promotional pricing, or limited-time access to certain features.

Unless otherwise stated:

  • eligibility for promotional offers is determined by us or the relevant platform provider;
  • we may modify or end promotions at any time;
  • after a free trial ends, the applicable paid subscription may begin automatically unless cancelled in time.

11. Intellectual Property

The Service, including its design, software, text, graphics, logos, audio, features, and content made available by us, is owned by or licensed to MD Teknoloji Bilişim ve Ticaret Anonim Şirketi and is protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not use our intellectual property without prior written consent.

All trademarks, service marks, and trade names are the property of their respective owners.

12. Third-Party Services

The Service may rely on or integrate third-party services, including but not limited to:

  • Firebase
  • RevenueCat
  • OpenAI
  • Sentry
  • DigitalOcean
  • Mixpanel
  • YouTube (Google LLC)

We are not responsible for third-party services, websites, products, or policies. Your use of third-party services may also be subject to their own terms and privacy policies.

13. YouTube Content

Den embeds video content from YouTube using the YouTube iframe embed feature provided by Google LLC. By using features of the Service that display YouTube videos, you acknowledge and agree to the following:

a. Compliance with YouTube Terms

Your access to and use of YouTube videos embedded within the Service is subject to the YouTube Terms of Service and Google's Privacy Policy. By using YouTube-enabled features in Den, you also agree to be bound by the YouTube Terms of Service.

b. Content Ownership

All video content accessed through YouTube is owned by YouTube (Google LLC) and/or the respective content creators. Den does not claim any ownership or rights over YouTube video content. All trademarks, service marks, and other intellectual property rights in YouTube content remain with their respective owners.

c. Prohibited Actions

When accessing YouTube content through the Service, you may not:

  • download, copy, screen-record, or locally store any YouTube video content;
  • redistribute, publicly perform, or commercially exploit any YouTube video content;
  • attempt to circumvent any technological measures or restrictions applied by YouTube or Google to video content;
  • use the embedded player in any way that violates the YouTube Terms of Service.

d. Content Availability

YouTube videos embedded in the Service may become unavailable at any time due to removal by the content owner, changes in YouTube's platform, geographic restrictions, or any other reason outside our control. Den is not responsible for the unavailability of any YouTube content and does not guarantee that any specific video will remain accessible.

e. No Endorsement

The availability of YouTube videos within Den does not constitute an endorsement of the content, the content creator, or any views or opinions expressed in those videos.

14. Privacy

Your use of the Service is also governed by our Privacy Policy.

By using Den, you acknowledge that we may collect, use, and process data as described in the Privacy Policy.

15. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. We may perform maintenance, updates, bug fixes, or changes that temporarily affect access.

16. Termination

We may suspend or terminate your access to the Service, with or without notice, if:

  • you violate these Terms;
  • we suspect fraud, abuse, or unlawful activity;
  • your use of the Service creates risk or harm for us, other users, or third parties.

You may stop using the Service at any time. You may also request account deletion by contacting us at dev.demirci@gmail.com.

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitation of liability, indemnity, and dispute-related provisions.

17. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

We do not warrant that:

  • the Service will meet your expectations or requirements;
  • the Service will be uninterrupted, error-free, or secure;
  • content or AI-generated outputs will always be accurate, complete, or reliable.

18. Limitation of Liability

To the maximum extent permitted by law, MD Teknoloji Bilişim ve Ticaret Anonim Şirketi and its directors, officers, employees, affiliates, partners, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the Service.

To the extent liability cannot be excluded, our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us for the Service during the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100), whichever is greater.

19. Indemnification

You agree to defend, indemnify, and hold harmless MD Teknoloji Bilişim ve Ticaret Anonim Şirketi and its affiliates, officers, employees, and service providers from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your use of the Service;
  • your violation of these Terms;
  • your violation of any law or third-party right;
  • your User Content.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict of law principles.

21. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved amicably by contacting us at dev.demirci@gmail.com.

If no amicable resolution is reached, disputes shall be subject to the jurisdiction of the courts and enforcement offices of Tokat, Türkiye, unless mandatory law requires otherwise.

22. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above.

If changes are material, we may provide additional notice through the Service or our website. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
